The 30-Day Window Starts at Arrest

You were arrested for DWI in Missouri yesterday. The Department of Revenue sent a notice of suspension effective in 15 days. Your attorney mentioned a Limited Driving Privilege, but the DMV website says you need SR-22 insurance filed first. You do not own a car right now, and you have a job interview Monday that requires driving.

Missouri runs two parallel suspension tracks after DWI arrest: the Department of Revenue administrative suspension (triggered by chemical test failure or refusal under RSMo 577.041) and the criminal court suspension (triggered by conviction). The administrative suspension imposes a 30-day hard period before you become eligible for a Limited Driving Privilege. That 30-day clock starts at arrest, not conviction. SR-22 filing does not pause it, but filing early positions you to activate the LDP the moment your 30 days expire.

The 30-day hard suspension clock starts at arrest, not conviction — SR-22 filing early positions you to activate the Limited Driving Privilege the moment eligibility opens.

Missouri DWI Hard Period

30 days

First-offense DWI with BAC over .08 triggers a 30-day mandatory suspension before Limited Driving Privilege eligibility under RSMo 302.309. Chemical test refusal extends this to 90 days.

SR-22 Required Before Reinstatement

Missouri requires SR-22 proof of financial responsibility for two years following DWI suspension. The SR-22 is not insurance itself — it is a certificate your insurer files electronically with the Missouri Department of Revenue confirming you carry at least the state minimum liability coverage: $25,000 per person, $50,000 per accident for bodily injury, and $25,000 for property damage.

You cannot petition for a Limited Driving Privilege without active SR-22 coverage on file with the DOR. You cannot reinstate your full license after suspension without it. The two-year SR-22 period begins when the DOR receives the filing, not when you buy the policy. A lapse in coverage during those two years triggers automatic suspension and restarts the clock.

Carriers write SR-22 policies for drivers who own vehicles and non-owner SR-22 policies for drivers who do not. If you do not currently own a car but need to drive occasionally (borrowed vehicles, employer-provided vehicles, rental cars), a non-owner SR-22 policy satisfies Missouri's filing requirement and typically costs $25–$50/month for liability-only coverage.

Missouri DOR processes SR-22 filings within 24-48 hours of carrier submission. The bottleneck is carrier processing time, not state processing time.

What Happens If You Miss the Filing Window

If your 30-day hard suspension expires and you have not filed SR-22 coverage, you cannot petition for a Limited Driving Privilege. The circuit court will deny your LDP application at the hearing. You will wait another 30 days minimum before you can re-petition, and the court has discretion to extend that wait based on your filing gap.

If you file SR-22 coverage but allow it to lapse before your two-year requirement period ends, the Missouri DOR suspends your license immediately. Your carrier is required to notify the DOR electronically within 24 hours of policy cancellation or non-renewal. The DOR does not send advance warning. The suspension is effective the day the lapse notification is received. Reinstatement requires a $20 reinstatement fee, a new SR-22 filing, and the two-year clock restarts from zero.

Missouri does not offer a grace period for SR-22 lapses. If your policy cancels for non-payment on the 15th and you bind new coverage on the 16th, you face suspension and reinstatement even though the coverage gap was one day. This makes continuous payment critical. Most carriers offering SR-22 policies require autopay enrollment to reduce lapse risk.

Missouri Reinstatement Fee

$20

Limited Driving Privilege Requires Court Petition

Missouri's Limited Driving Privilege is granted by the circuit court in the county where you reside, not by the Department of Revenue. You petition the court after your 30-day hard suspension period ends. The petition requires proof of SR-22 insurance on file with the DOR, proof of employment or another qualifying need (school enrollment, medical treatment, alcohol/drug treatment as ordered), and verification of ignition interlock device installation if the court orders it.

The LDP is not automatic. The judge has discretion to deny your petition or impose stricter conditions than statute requires. If your SR-22 filing lapses during the LDP period, the court can revoke the privilege without a hearing. You cannot petition for an LDP in a county other than your county of residence, even if your arrest occurred elsewhere.

Compare Carriers in Your County

Missouri SR-22 rates vary by carrier, county, age, and prior violations. A 28-year-old driver in St. Louis County with one DWI typically pays $110–$180/month for liability-only SR-22 coverage. A 45-year-old driver in Greene County with the same record typically pays $85–$140/month. Non-owner SR-22 policies cost less because they exclude vehicle collision and comprehensive coverage.

Request quotes from at least three carriers writing SR-22 in Missouri before binding.
